You agree to use our website and services only for lawful business purposes. You may not use our services to violate applicable laws or regulations, infringe upon the rights of others, distribute unlawful or deceptive communications, interfere with our systems, or engage in fraudulent or abusive activity.
3. AI and Automated Services
Certain NexScale AI services may use artificial intelligence, automated workflows, AI agents, voice technology, CRM systems, and third-party technology platforms.
AI-generated responses and automated actions may not always be error-free. Customers are responsible for reviewing their configurations, business information, offers, and other material used by automated systems and for ensuring their use of these systems complies with applicable laws and industry requirements.
4. SMS/Text Messaging Terms
SMS Program Description and Use Cases: When you voluntarily provide your mobile telephone number and expressly consent to receive SMS/MMS messages from NexScale AI, you may receive text messages consistent with the consent you provided. Messages may include responses to inquiries, appointment confirmations and reminders, service-related communications, customer support, follow-up messages, informational messages, and, when you have provided appropriate marketing consent, promotional or marketing communications.
Message Frequency: Message frequency may vary.
Message and Data Rates: Message and data rates may apply.
Opt-Out Instructions: You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you may receive a final confirmation message.

Consent: Consent to receive marketing text messages is not a condition of purchase.
Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

Mobile Information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. Email Communications
If you provide your email address, NexScale AI may send service-related, transactional, informational, and, where permitted, marketing communications. You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those messages.
6. Fees and Payment
Pricing and payment terms for paid NexScale AI services will be disclosed before purchase or contained in the applicable proposal, invoice, order, or service agreement. You agree to pay authorized charges according to the terms presented at the time of purchase.
Recurring services, when applicable, may continue until canceled in accordance with the applicable service agreement or subscription terms.
7. Third-Party Services
Our services may integrate with or rely upon third-party platforms, including CRM, communications, payment, hosting, analytics, artificial intelligence, and automation providers. NexScale AI does not control the availability, policies, or performance of independent third-party services.
8. Intellectual Property
Unless otherwise stated in a written agreement, NexScale AI retains ownership of its proprietary systems, processes, methodologies, templates, documentation, branding, and other intellectual property. You may not copy, reproduce, distribute, resell, or exploit proprietary NexScale AI materials without authorization.
9. No Guarantee of Results
Business, marketing, lead generation, automation, and AI-related results vary. NexScale AI does not guarantee specific revenue, profits, lead volume, appointment volume, conversion rates, or other business outcomes.
10. Disclaimer of Warranties
To the extent permitted by applicable law, our website and services are provided on an “as is” and “as available” basis. We do not warrant that every service, automation, AI response, integration, or third-party system will operate without interruption or error.
11. Limitation of Liability
To the extent permitted by applicable law, NexScale AI will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website or services. Any additional limitations applicable to a paid engagement may be stated in the applicable service agreement.
12. Privacy
Your use of our website and services is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect information.
